Fraudulent Activities

The factors used to determine any case of fraudulent activities (e.g. streaming manipulation, improper marketing activities) will be evaluated on a case by case basis by the Company.

Certain Consumer Stores may also have policies related to fraud and suspected fraudulent activities and the End-user agrees that it is his responsibility to investigate such policies and such policies shall be binding on the End-user hereunder.

In the event that the Company has, in its good faith and sole discretion, reason to suspect that your account or certain content have been subjected to, involved in, or generated revenue from any activity that violates the Terms, fraud, copyright infringement or any other intellectual property right infringement, failure to comply with any third-party license requirement, or Streaming Inflation (collectively, “Fraudulent Activities”), the Company reserves the right to (i) discontinue the posting of income, including any Net Income or other payments to your account, (ii) block your ability to otherwise withdraw funds from your account until a resolution of the suspected activities is obtained to the full satisfaction of the Company. Upon Company’s determination that your account or Content have been subjected to, involved in, or generated revenue from Fraudulent Activities, you agree that all revenue in your account that has been frozen by the Company is forfeited, regardless of whether it was generated from any specific Release(s) or Consumer Store(s).

You agree that the Company’s good faith determination of Fraudulent Activities can be based on streaming or other activities that are the same or similar to cases that the Company has previously determined involved Fraudulent Activities. A corresponding notification by any Consumer Store is also considered as sufficient evidence for Fraudulent Activity.

The payment of revenues to you by the Company does not constitute Company’s acknowledgement that such revenues were not the result of any Fraudulent Activity.

The Company has no duty to investigate Fraudulent Activities unless and until it freezes revenues in your account.

If the Company determines that revenues generated to your account are the result of Fraudulent Activities, and such revenues have already been paid out to you, you agree to return such revenues to the Company.

You agree that you will not be entitled to reimburse any fees paid by you to the Company if the Company determines that you were involved or revenue was generated by Fraudulent Activities.

Any costs incurred by the Company (including legal fees and expenses) in connection with Fraudulent Activities may, in addition to its other remedies, be deducted by the Company from any funds otherwise payable to you.

The Company reserves the right to engage an attorney to further investigate potential Fraudulent Activities. The corresponding costs shall be deducted from the involved End-user’s account or otherwise beared by the involved End-user.
